Terms & Conditions
Last updated 28 September 2026
This document is written in English. If it is shown to you in another language, the English text is the one that applies.
These Terms & Conditions (the "Terms") are an agreement between you and JomTP ("we", "us"). They govern your use of the JomTP trading journal: the website at jomtp.com, the web app, the JomTP iOS app, the companion JomTP Mentor app, and the APIs behind them (together, the "Service").
By ticking the consent box at sign-up, creating an account, or using the Service, you accept these Terms together with our Privacy Policy and our Risk Disclaimer, which both form part of this agreement. If you do not agree, do not create an account, and stop using the Service.
1. The agreement
- What you are accepting. These Terms, the Privacy Policy and the Risk Disclaimer, as published on the Service on the date you accept them, together with any rules posted against a particular feature, which are incorporated here by reference. Each revision carries a version (this one is 2026-09-28.1); the version you accepted at sign-up is recorded against your account.
- "Affiliates" means our owners, officers, directors, employees, contractors, suppliers, hosting and infrastructure providers, and anyone else involved in creating, operating or delivering the Service. Where these Terms protect us — in particular sections 13, 14 and 15 — they protect our Affiliates on the same footing, and each of them may rely on those sections.
- Beta version. JomTP is currently a pre-release service. Section 3 sets out what that means. Where a clause describes paid plans, it applies only once paid plans are launched and you choose to subscribe.
- Nothing here is financial advice. JomTP records and analyses trades you have already made. It does not, and cannot, tell you what to trade. See section 13 and the Risk Disclaimer.
2. Who can use JomTP
- You must be at least 18 years old, legally able to enter into a binding contract, and not barred from using services like this one under the laws of the country you live in. By accepting these Terms you confirm all three.
- You are using the Service to keep records of your own trading, or, in the Mentor app, to read the records of a trader who chose to share them with you. Managing other people's exchange accounts through JomTP is not permitted.
- One person, one account. Do not let anyone else use your account, and do not use anyone else's.
- Invite codes issued during the beta are personal to the person they were given to. Do not sell, publish, or bulk-share them. We may revoke codes that are misused and close accounts created with them.
3. Beta programme
JomTP is offered to invited testers as a beta. That means all of the following, and you accept them as the price of early access:
- It is free for now. Every tester who signs up with an invite code receives the full feature set at no charge for the duration of the beta. Paid plans will be announced in advance. Nothing on your account starts charging on its own; you would have to go through checkout and enter a payment method yourself.
- It will change. Features may be added, altered, limited, or removed without notice. Limits, layouts, and defaults may be reset. Brokers marked "beta" or "coming soon" in the app are exactly that.
- It may break. Syncs can stall, figures can be delayed, incomplete, or wrong, and the Service may be unavailable for periods without warning. We give no uptime commitment during the beta.
- Keep your own records. Your exchange remains the authoritative record of your trades. We are still building out our backup arrangements during the beta, so use Settings → Export my data regularly and do not treat JomTP as the only copy of anything you cannot afford to lose.
- Ending or changing the beta. We may pause, restrict, or end the beta, or move accounts onto a launch plan, at any time. Where we can, we will give at least 14 days' notice in the app or by email and a window in which to export your data.
- Feedback. If you send us suggestions, bug reports, or other feedback, you allow us to use it freely, without any obligation to you, without attribution, and without it becoming confidential.
4. The service
JomTP is a journal and analytics tool for crypto perpetual-futures traders. It reads your trading activity from your exchange through read-only API keys, reconstructs your positions, computes statistics from them (R-multiples, hit rates, expectancy, and the like), and gives you a place to write about them, build playbooks, and run backtests and chart replays.
- We are not a broker, an exchange, a wallet, or a custodian. JomTP never holds your funds and never places, modifies, or cancels an order. It cannot: the Service refuses any API key that carries trading or withdrawal permissions.
- Provenance, not certainty. Every level and figure in the app is labelled with where it came from — an exchange order, a live position, or something you typed. That labelling is a feature, not a guarantee: exchange data can lag, be corrected, or be incomplete, and reconstructed positions can differ from what your exchange shows. Check anything that matters against the exchange itself.
- Charts and market data are drawn from the exchanges' public market feeds, either directly from your device or, when your region cannot reach an exchange, through a relay we operate. Market data is provided for your use within the Service and is not ours to redistribute.
- You supply the equipment. A device, a browser or the app, and an internet connection are yours to provide and pay for, including any data charges. The Service needs a working connection to your exchange; we are not responsible for your network, your device, or your exchange's availability.
- What the Service can do differs by broker and by plan. The current matrix is shown in the app and may change (section 3).
5. Your account
Registration
- The details you give us when you register must be true, accurate and yours, and you must keep them current. We may suspend or close an account registered with false information.
- You are responsible for everything done through your account, whether or not you did it.
Keeping your account secure
- Keeping your password and your session confidential is your responsibility. Choose a strong password and do not reuse one from elsewhere.
- We will never ask you for your password. Anyone who does is not us. We will never ask you to send us an API secret by email or chat either.
- Do not transfer, sell, or share your account. We may close an account that is shared or resold.
- Tell us at support@jomtp.com immediately if you believe someone else has used your account, your password, or your keys. We are not liable for losses arising from your failure to keep them secure or to tell us promptly.
Your exchange keys
- Only ever connect read-only keys. We check a key's permissions when you save it and reject keys that can trade or withdraw, but exchanges change their permission models and you remain responsible for the permissions you grant at the exchange and for rotating keys you no longer trust. If an exchange later tells us a key is invalid, we stop using it and say so in the app.
- Connecting an account authorises us to make read-only requests to your exchange with that key, from our servers and relays as well as from your browser, as often as needed to keep the journal current, including pulling the full history the exchange makes available.
- Your exchange's own terms continue to apply to you. We are not affiliated with, endorsed by, or responsible for any exchange, and an exchange may rate-limit, block, or change its API at any time.
6. Your data and content
- Your data stays yours. Trades, journal entries, tags, playbooks, backtests, chart drawings, screenshots, and anything else you create in the Service belong to you. You can export all of it, or delete all of it, at any time from Settings.
- So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, analyse, transmit, and display that content, and to make backups of it, solely to provide, secure, and improve the Service as described in the Privacy Policy. The licence ends when the content is deleted, except for copies in backups, which age out on their own schedule.
- You warrant that you may share what you upload. You either own your content or have the rights you need to put it into the Service, and it does not breach anyone's copyright, trade secrets, privacy, or a confidentiality obligation you are under. Do not paste in anything you are not allowed to disclose, and do not put credentials, card numbers, or other people's personal information into a note.
- Mentor sharing is your choice. If you give a mentor a link code, that mentor can read the trades on the accounts you chose, and can comment on them, until you revoke the link. Comments you have already received stay in your journal after revocation. Sharing your journal with a mentor extends the same licence above to that mentor for the purpose of reading and commenting. Your relationship with a mentor is between you and them; we are not a party to it, we do not vet mentors, and we are not responsible for anything they say or do.
7. Acceptable use
You agree not to, and not to help anyone else to:
- access the Service by automated means (scrapers, bots, bulk downloaders) other than the features we provide for that purpose;
- copy, decompile, reverse-engineer, or otherwise try to extract the source code, models, or design of the Service, or use any part of it to train a machine-learning model;
- bypass or probe the invite gate, plan limits, rate limits, or any security or access control, or use your account to attack another account, network, or server;
- connect API keys, or read journals, that you are not authorised to use;
- overload, disrupt, or interfere with the Service, its infrastructure, or the exchanges it talks to, or with anyone else's use of it;
- upload or transmit malicious code, or anything designed to damage, disable, or gain unauthorised access to software, hardware, or data;
- resell, sublicense, rent, white-label, or otherwise commercially exploit the Service or any part of it, or present it as your own;
- impersonate anyone, or misrepresent your relationship with anyone; or
- use the Service for anything unlawful, including market manipulation or laundering the proceeds of crime.
Content standards. Anything you write in the Service that another person can see — a note shared with a mentor, a mentor's comment, a message to us — must not be unlawful, threatening, abusive, harassing, defamatory, deceptive, or an invasion of anyone's privacy; must not attack or degrade anyone on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; must not infringe anyone's intellectual property; and must not be unsolicited advertising, spam, or a solicitation of any kind.
8. Content we host, and content we remove
- We do not review your journal. Content you create is not pre-screened, monitored, or edited by us, and we do not endorse it or take responsibility for it. Nothing here obliges us to monitor anything.
- We may remove it anyway. We may remove or restrict access to any content, and suspend or close the account behind it, if in our judgement it breaches these Terms or the law, or is harmful to other users or to the Service. We may do this without prior notice, and we are not liable for removing it — nor for failing to remove it, or for taking time to.
- If you believe content on the Service infringes your rights, write to support@jomtp.com with enough detail to identify the content and the right you say is infringed, and we will look into it.
9. Third-party services and links
- The Service links to and depends on parties we do not control: your exchanges, our hosting, database and payment providers, the charting library, and any site we link to. We do not control their content, availability, accuracy, security, or terms, and we do not endorse them.
- A link or a reference is a convenience, not a recommendation, and creates no association between us and the party linked to.
- Your dealings with a third party — an exchange above all — are between you and them, on their terms. We are not liable for anything that arises from them, including an exchange changing its API, restricting your account, going offline, or reporting data incorrectly.
10. Plans & payment
During the beta this section is dormant: there is nothing to pay and nothing to cancel (section 3). It applies once paid plans launch and you subscribe.
Plans
JomTP will have a free tier and paid tiers (currently named Pro and Elite). What each tier includes — how many exchange accounts can be synced, how much trade history is visible, and which features (backtesting, replay, advanced indicators and dashboards) are unlocked — is described on the billing page at the time you subscribe and may change with notice.
Payment
- Prices are shown in US dollars on the billing page. Payments are processed by Stripe; card details go to Stripe and never reach our servers.
- Subscriptions renew automatically at the end of each billing period (monthly or yearly, as chosen at checkout) until cancelled. By subscribing you authorise that recurring charge.
- Prices exclude any tax that applies in your country. Where we are required to collect it, it is added at checkout.
- If a renewal payment fails, we will retry and let you know. If it keeps failing, the account returns to the free tier; nothing is deleted.
- We may change prices. A change to a renewing subscription takes effect from the next renewal after at least 30 days' notice, so you always have the chance to cancel first.
Cancelling, downgrading, refunds
- You can cancel at any time from Settings → Plan & billing. Cancelling does not cut you off: you keep the plan until the end of the period you already paid for, then move to the free tier.
- Cancelling is your responsibility. Cancel before a renewal date if you do not want that renewal. Forgetting to cancel, or not using the Service during a period you paid for, is not a ground for a refund.
- Payments are final and non-refundable, including part-used periods. If you were charged in error, or the Service was materially broken for you, write to us and we will put it right. Any statutory right to a refund or cancellation that applies to you as a consumer is unaffected by this clause.
- Downgrading never deletes anything. Data outside the free tier's limits — for example older trades — becomes hidden in the app, not erased, and reappears if you subscribe again. You can export everything at any time regardless of plan.
11. Intellectual property
- The Service — its software, design, text, graphics, statistics engine, and the JomTP name, logo and marks — belongs to JomTP or its licensors and is protected by copyright, trade mark and other laws. Apart from the limited licence below, no rights in it are granted to you, and nothing here gives you the right to use our name, logo or marks.
- We grant you a personal, limited, revocable, non-transferable, non-exclusive licence to use the Service, through the interfaces we provide, to keep and analyse records of your own trading. You may keep a copy of your own data for your own use; you may not copy, republish, redistribute, or commercially exploit any other part of the Service without our written permission.
- We do not warrant that your use of anything obtained through the Service will not infringe a third party's rights, and it is your responsibility to obtain permission before reusing material that belongs to someone else.
- Exchange names and logos belong to their respective owners and are used only to identify the venues you connect. Charts are rendered with the TradingView Charting Library under licence from TradingView.
- Section 6 governs your own data; nothing in this section takes it from you.
12. Availability & changes
- The Service depends on exchange APIs that rate-limit, throttle, change, and fail. Syncs run on a schedule that varies with activity; after an exchange temporarily blocks us we wait it out rather than make it worse. Figures can therefore be delayed or incomplete at any time.
- Interruptions, maintenance windows, and delays on networks we do not control are normal events, not breaches of this agreement.
- We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we are not liable to you or anyone else for doing so. New features are covered by these Terms.
13. No advice, no warranty
Not advice
- Nothing in the Service is a recommendation to buy, sell, hold, or hedge any asset, or to follow any strategy. Statistics, R-multiples, hit rates, playbook scores, backtests, and replays describe the past and are provided for information and self-review only. We are not licensed financial, investment, or tax advisers, and we do not advocate any particular trade or instrument. Your trading decisions are yours alone. The Risk Disclaimer forms part of these Terms.
- We trade too. JomTP, its Affiliates and the people behind it are active market participants and may hold, open, or close a position in any instrument that appears anywhere in the Service, at any time, without notice. Nothing displayed to you is a signal, and no position of ours is a view offered to you.
Accuracy
- We distribute exchange data; we do not author it. Positions, fills, fees, funding and prices originate with your exchange and its market feed. We do not warrant or guarantee that any of it — or anything derived from it — is accurate, complete, current, or useful, and we are not responsible for an exchange's errors, corrections, or omissions.
- Hypothetical results. Backtests, replays, and simulations are hypothetical. They do not reflect real fills, fees, funding, slippage, or liquidity, and they say nothing about the future.
- The Service may contain technical, typographical, or other errors, and may be out of date. We may change it at any time and are under no obligation to update it.
"As is"
To the fullest extent the law allows, the Service and everything in it are provided "as is" and "as available", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting that, we do not warrant that the Service will meet your requirements, that it will be uninterrupted, timely, secure or error-free, that any result obtained from it will be accurate or reliable, or that any figure in the app matches your exchange. We accept no responsibility for the deletion, non-delivery, or failure to store any content or setting. You use the Service, and download anything from it, at your own risk and are responsible for any damage to your device or loss of data that results. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
- To the fullest extent the law allows, neither we nor our Affiliates are liable to you or to any third party for any trading losses, lost profits, lost or corrupted data, loss of business, goodwill or opportunity, or any indirect, incidental, special, punitive, or consequential loss, however caused and on any theory of liability, arising out of or in connection with the Service or any site linked from it — even if we were told such loss was possible.
- We are not liable for goods or services supplied by a third party through or alongside the Service, including anything to do with your exchange or with the processing of a payment.
- To the fullest extent the law allows, our total liability, and that of our Affiliates, for everything arising out of or connected with the Service in any twelve-month period is limited to the greater of the amount you paid us for the Service in that period and USD 100. During the beta you pay nothing, so the second figure applies.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or for death or personal injury caused by negligence, and nothing here takes away consumer rights that the law of your country gives you and that cannot be waived by agreement. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
15. Your responsibility for misuse
You agree to defend, indemnify, and hold us and our Affiliates harmless from all liabilities, claims, demands, losses and expenses, including reasonable legal fees, arising out of or connected with your use or misuse of the Service, the content you put into it, your breach of these Terms, or your violation of any law or of a third party's rights, including an exchange's terms. We may take over the exclusive defence and control of any matter you would otherwise indemnify us for, at our own expense, and you will cooperate with us in asserting any available defence.
16. International use
- The Service is operated from Malaysia. That it can be reached from where you are does not mean it is appropriate, lawful, or available there.
- Crypto trading and crypto-related services are restricted or prohibited in some countries. If you access the Service from such a place, you do so on your own initiative and you are responsible for complying with your local law. Any offer made through the Service is void where prohibited.
- We may block or restrict access from a jurisdiction at any time, including where a law, a sanctions regime, or a provider's terms require it.
17. Termination
- By you. Stop using the Service whenever you like. To delete your account, use Settings → Delete my account. Deletion is immediate and permanent; export first if you want to keep anything.
- By us. We may suspend or close your account, with or without notice and at our discretion, if you breach these Terms, if the law requires it, if your account poses a risk to the Service or to other users, if we suspect fraudulent, abusive or illegal activity, if the account has been inactive for a long time, or when the beta ends (section 3). Suspected criminal activity may be referred to the authorities, and we will cooperate with a lawful investigation.
- On suspension or closure your right to use the Service ends immediately, and we may deactivate or delete your account and its data. We are not liable to you or anyone else for any claim arising out of a termination or suspension. Where practicable we will give notice and a chance to export your data first.
- Sections 6 (to the extent of backup copies), 11, 13, 14, 15, 18 and 21 survive termination.
18. Governing law and disputes
- These Terms are governed by the laws of Malaysia, without regard to its conflict-of-law rules, and without regard to the United Nations Convention on Contracts for the International Sale of Goods.
- Talk to us first. If you have a dispute with us, email support@jomtp.com and we will try to resolve it informally within 30 days.
- If that fails, the courts of Malaysia have exclusive jurisdiction and you submit to their personal jurisdiction and venue — except that if you are a consumer in a country whose law gives you the right to bring proceedings at home, that right is unaffected.
19. Changes to these terms
- We may revise these Terms, the Privacy Policy, and the Risk Disclaimer. The "last updated" date at the top and the version number change when we do, and it is your responsibility to check them from time to time.
- Minor or clarifying changes take effect when they are published. For a material change we will tell you in the app or by email at least 14 days before it takes effect, where practicable.
- Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not, stop using the Service and delete your account before that date.
20. Notices
- We send notices to the email address on your account, or show them in the app. A notice shown in the app or sent to that address counts as given when we send it, so keep the address current and reachable.
- Notices to us must go to support@jomtp.com.
21. General
- Entire agreement. These Terms, the Privacy Policy, and the Risk Disclaimer are the whole agreement between you and us about the Service and replace anything said before. They cannot be varied by any other document, purchase order, or terms you send us; any attempt to do so is void unless we agree in writing.
- Time limit on claims. Any claim you bring against us or our Affiliates arising out of the Service must be started within 12 months of the date it arose, or it is permanently barred — except where the law of your country does not permit that limit.
- Costs. In any action to enforce these Terms, the party that prevails is entitled to its costs and reasonable legal fees.
- Assignment. You may not assign or transfer your rights or obligations under these Terms, and any attempt to do so is void. We may assign ours, including to a successor of the Service, and will tell you if we do.
- No resale. You may not sell, resell, reproduce, duplicate, copy, or exploit any part of the Service, or access to it, for a commercial purpose.
- Force majeure. Neither of us is responsible for delay or failure caused by events outside our reasonable control, including exchange outages, internet and network failures, acts of a provider or a government, industrial action, fire, war, and natural events.
- Severability and waiver. If any part of these Terms is unenforceable, it is read as closely as possible to its original intent and the rest stays in force. If we do not enforce a right straight away, we have not given it up.
- Language. These Terms are written in English. Translations of headings are for convenience; the English text is the binding one.
